This document establishes the general conditions of use (hereinafter "CGU") of this website (hereinafter "the Site"), published and operated by the GALERIE CINDY LECOMTE brand, owned by the company CINDY LECOMTE.
Users must carefully read these Terms and Conditions and the Legal Notices before using the Site. By using this Site, the User agrees to be bound by these Terms and Conditions and the Legal Notices.

ARTICLE 1. DEFINITIONS
• Customer Account: the User's personalized space resulting from the creation of the account. It allows the User to manage their personal information, track their orders, view their order history, and download their invoices.
• GALERIE CINDY LECOMTE: a single-member simplified joint-stock company with a share capital of €5,000, whose registered office is located at 231 rue Saint-Honoré – 75001 PARIS, registered with the Paris Trade and Companies Register under SIRET number 988 932 331, represented by Mrs. Cindy BROCHOT, president. GALERIE CINDY LECOMTE is the publisher of the Site.
• Site: designates the website www.galeriecindylecomte.com accessible to all via a search engine (Google, Bing, Yahoo etc.).
• User(s): means any person having access to and/or using the Site.
• Work(s): designates all goods, tangible and intangible, offered for sale by GALERIE CINDY LECOMTE (examples: work of art, reproduction, art object, handcrafted good, book, catalog, merchandising, etc.).
ARTICLE 2. DURATION AND TERRITORY
The duration of the T&Cs is indefinite and the T&Cs apply worldwide.
ARTICLE 3. ACCEPTANCE OF THE T&Cs AND LEGAL NOTICES
Access to and use of the Site are subject to acceptance and compliance with these T&Cs and the Legal Notices available HERE (which include in particular the confidentiality policy and cookie management as well as the User's obligations regarding intellectual property).
By browsing the Site, regardless of the technical means of access and the terminals used, the User is presumed to know and to have read in full these T&Cs as well as the Legal Notices and to accept their terms without reservation. The T&Cs and the Legal Notices are applicable and binding on the User on the date of the first use of the Site by the latter.
These T&Cs apply, as necessary, to any variation or extension of the Site on existing or future social and/or community networks.
The User may at any time cease using the Site but remains responsible for any prior use.
ARTICLE 4. CONTENT AND ACCESS TO THE SITE
The Site constitutes a platform for marketing Works.
The website www.galeriecindylecomte.com offers the User the following services in French and English:
• Presentation of the CINDY LECOMTE GALLERY;
• Online catalog of works;
• Sale of works online;
• Presentation of current events and exhibitions;
• Presentation of artists and works of art;
• Appointment booking;
• Newsletter;
• Editorial space;
• Press and media area;
• Contact and geolocation. The “contact” section allows you to fill out a form to put the User in contact with GALERIE CINDY LECOMTE.
Users are informed that the services previously listed are subject to change.
The Site is accessible free of charge anywhere to any User with Internet access. All costs incurred by the User to access the Site (computer hardware, software, Internet connection, etc.) are their responsibility.
ARTICLE 5. CUSTOMER ACCOUNT
The Customer Account is open to any User. It allows the User to access the following features:
• Manage and modify your personal information (first name, last name, telephone address, email); • View purchase history; • Track orders and deliveries; • Download the invoice.
Creating a Customer Account requires acceptance of the Legal Notices (HERE), the General Terms and Conditions of Sale (HERE) and these T&Cs. It requires the provision of data such as first name(s) and last name(s), email address, telephone number and postal address.
The User is entirely responsible for the accuracy of the data transmitted and for updating them; he/she will bear the consequences of any error arising from the inaccuracy of the data (in particular the email address or postal address).
A username (email address) and password must be defined by the User. The User accesses the Customer Account by providing their username and password. The User must keep this password confidential.
The data provided in the Customer Account are provided for information purposes only. In the event of a discrepancy between the data available in the Customer Account and that appearing on the invoice received/downloaded by the Customer, only the latter invoice shall constitute proof of the sales made.
The Customer Account is free. Internet access is the responsibility of the User.
The Customer Account can be terminated by the User at any time directly from the Customer Account or by sending a termination request by email to GALERIE CINDY LECOMTE: contact@galeriecindylecomte.com
ARTICLE 6. NEWSLETTER AND CONTACT
The User has the option to complete a form in order to receive newsletters from GALERIE CINDY LECOMTE. To do so, they will need to provide their email address.
The User also has the option of contacting GALERIE CINDY LECOMTE via the “Contact” tab (email address and telephone number).
ARTICLE 7. RESPONSIBILITIES
7.1. Responsibility of GALERIE CINDY LECOMTE
GALERIE CINDY LECOMTE uses all reasonable means at its disposal to ensure access to the Site. The Site is accessible 24 hours a day, 7 days a week except in cases of force majeure or the occurrence of an event beyond the control of GALERIE CINDY LECOMTE and subject to possible breakdowns and maintenance interventions.
GALERIE CINDY LECOMTE cannot be held responsible for any malfunction of the network and/or servers or any other event beyond its control, which would prevent or degrade access to the Site.
GALERIE CINDY LECOMTE reserves the right to interrupt, suspend or modify without notice access to all or part of the Site, in order to ensure maintenance, or for any other reason, without the interruption giving rise to any obligation or compensation of any kind whatsoever.
GALERIE CINDY LECOMTE strives to ensure, to the best of its ability, the accuracy and updating of the information published on the Site, the content of which it reserves the right to correct at any time and without notice.
However, GALERIE CINDY LECOMTE cannot guarantee the accuracy, precision and completeness of the information made available on the Site, which information does not constitute a guarantee or a commitment on the part of GALERIE CINDY LECOMTE with regard to the User. The User alone assumes full responsibility for the use of the information and contents of this Site.
Any downloaded content is done at the User's own risk and under their sole responsibility. Consequently, GALERIE CINDY LECOMTE cannot be held responsible for any damage to the User's computer or any loss of data resulting from the download.
The Site may contain hyperlinks to third-party sites. GALERIE CINDY LECOMTE cannot be held liable if the content of these third-party sites does not comply with current legal or regulatory provisions.
GALERIE CINDY LECOMTE implements means intended to ensure the security of files created from personal data collected on the Site. However, it is reminded that it does not control the risks linked to the functioning of the Internet and draws Users' attention to the existence of possible risks in terms of confidentiality of data transmitted via this network.
GALERIE CINDY LECOMTE cannot be held responsible in the event of legal action taken against Users who have made improper use of the Site or its services.
7.2. User Responsibility
The User accesses and uses the Site under his/her sole responsibility.
The User agrees to use the Site in compliance with these T&Cs and the Legal Notices (HERE) as well as applicable laws and regulations.
All hardware and software required to access and use the Site remain the sole responsibility of the User, who remains solely responsible for the proper functioning of his or her equipment and Internet access. It is therefore the User's responsibility to take all appropriate measures to protect his or her own data, computer systems and/or software from contamination by any viruses. The User is solely responsible for his or her use of the Site and the content he or she downloads from the Site.
The User undertakes to use the Site only under the conditions defined by these T&Cs and thus:
• not to divert the use of the contents for personal, commercial and/or advertising purposes;
• not to fraudulently access and/or remain on the Site;
• not to hinder or alter the operation of the Site;
• not to or in any case introduce, delete or modify data which are contained in the Site;
• not to disrupt the proper functioning of the Site, and in particular not to introduce viruses.
ARTICLE 8. INTELLECTUAL PROPERTY
The Site and the elements that compose it (texts, photographs, videos, illustrations, logos, animations, etc.) constitute intellectual works protected by articles L.111-1 et seq. of the Intellectual Property Code.
Mrs. Cindy BROCHOT is the owner of the French trademark GALERIE CINDY LECOMTE n°5141806.
The Site and the elements that compose it are the exclusive property of GALERIE CINDY LECOMTE or the latter benefits from a license allowing commercial exploitation.
The use of all or part of the Site, including downloading, reproduction, transmission, representation or distribution, for purposes other than personal and private use and for non-commercial purposes by the Internet user is strictly prohibited. The offender is liable to the sanctions provided for both by the Intellectual Property Code in matters of copyright infringement and trademark law and by the Civil Code in matters of civil liability.
It is prohibited to create any hyperlink to any of the web pages or any of the elements of the Site without the prior written authorization of GALERIE CINDY LECOMTE. This authorization may be withdrawn at any time. All websites with a hyperlink to the Site or one of its components are not under the control of GALERIE CINDY LECOMTE. GALERIE CINDY LECOMTE formally declines all responsibility (including editorial) concerning access to and the content of these sites.
Acceptance of these T&Cs constitutes recognition by the User of the intellectual property rights of GALERIE CINDY LECOMTE and an undertaking to respect them.
Users also acknowledge the rights of GALERIE CINDY LECOMTE to all databases on the Site. GALERIE CINDY LECOMTE is considered the producer of these databases within the meaning of Article L. 341-1 of the Intellectual Property Code.
Consequently, Users are strictly prohibited from extracting, permanently or temporarily, by any means or in any form whatsoever, all or part of the content of the Site's databases to another medium, as well as from reusing all or a significant part of the content of the Site's databases, in any form whatsoever, including via a hyperlink.
In general, any extraction, use, storage, reproduction, representation or conservation (direct or indirect, partial or total, qualitatively or quantitatively substantial) of the content of the GALERIE CINDY LECOMTE databases, carried out by the processes mentioned above, is formally prohibited.
ARTICLE 9. MODIFICATIONS TO THE T&Cs
The T&Cs may be modified unilaterally and at any time by GALERIE CINDY LECOMTE, in particular to adapt them to legislative or regulatory changes, to adapt them in the event of modification or removal of functionalities on the Site. These modifications are published by their posting online and are deemed to be accepted without reservation by any User who accesses the Site after their posting online.
The User is recommended to refer to the latest version of the T&Cs of the website, accessible at any time on the Site, before any navigation.
ARTICLE 10. FORCE MAJEURE
GALERIE CINDY LECOMTE cannot be held liable if it is unable to fulfill its obligations or if it performs them late, due to an event of force majeure recognized by article 1218 of the Civil Code and the decisions of the French courts.
ARTICLE 11. PARTIAL NULLITY
If one or more of the terms of these T&Cs should be held to be null and void or declared as such pursuant to a law, regulation or following a decision that has become final and binding by a competent court, the other terms shall remain valid and applicable.
ARTICLE 12. APPLICABLE LAW AND COMPETENT JURISDICTIONS
These T&Cs are governed by French law.
Any dispute relating to their existence, validity, interpretation and execution would be submitted to the competent court within the jurisdiction of the Paris Judicial Court.
